【產(chǎn)通社，6月26日訊】6月20日以來的一周內(nèi)，美國(guó)國(guó)際貿(mào)易委員會(huì)（USITC）先后在橡膠樹脂及制造方法（certain rubber resins and processes for manufacturing same），以及電子成像設(shè)備領(lǐng)域，主要針對(duì)中國(guó)企業(yè)發(fā)起“337調(diào)查”，以確定是否存在專利侵權(quán)行為。
6月20日，USITC決定對(duì)部分橡膠樹脂及制造方法啟動(dòng)337調(diào)查，涉案產(chǎn)品是人造橡膠樹脂，包括用于輪胎制造的增粘劑。該調(diào)查緣于圣萊科特國(guó)際集團(tuán)（SI Group）5月21日向美國(guó)USITC提出的申請(qǐng)，指控美國(guó)進(jìn)口及美國(guó)國(guó)內(nèi)市場(chǎng)銷售的部分橡膠樹脂，包括“增粘劑”侵犯了其商業(yè)秘密，要求啟動(dòng)337調(diào)查，并發(fā)布排除令和禁止令。美國(guó)ITC最終確定下列企業(yè)作為本案的強(qiáng)制應(yīng)訴方：

6月25日，USITC決定對(duì)中國(guó)大陸及臺(tái)灣多家企業(yè)生產(chǎn)的電子成像設(shè)備發(fā)起“337調(diào)查”，以確定是否存在專利侵權(quán)行為。本次調(diào)查緣起5月23日美國(guó)新罕布什爾州的閃點(diǎn)技術(shù)公司（FlashPoint Technology, Inc.）向美國(guó)USITC提出的申請(qǐng)，指控美國(guó)進(jìn)口及在美國(guó)市場(chǎng)銷售的上述涉案產(chǎn)品侵犯了該公司專利，要求啟動(dòng)“337調(diào)查”，并發(fā)布排除令和禁止進(jìn)口令。美國(guó)ITC最終確定下列企業(yè)作為本案的強(qiáng)制應(yīng)訴方：

一月前的5月18日，USITC對(duì)全球45家公司發(fā)起“337調(diào)查”，以確定這些公司在生產(chǎn)帶有可伸縮USB連接器（retractable USB connector）的電子設(shè)備時(shí)是否存在專利侵權(quán)行為，調(diào)查產(chǎn)品主要是照相機(jī)、便攜攝像機(jī)、數(shù)碼錄音機(jī)、MP3播放器、無線調(diào)制解調(diào)器和閃存驅(qū)動(dòng)器等帶有可伸縮USB連接器的電子設(shè)備，被調(diào)查企業(yè)包括多家亞洲知名電子設(shè)備生產(chǎn)商，如中國(guó)華為技術(shù)有限公司、日本奧林巴斯、日本松下、日本東芝和韓國(guó)三星等。
美國(guó)所謂“337調(diào)查”最早得名于《1930年美國(guó)關(guān)稅法》第37條款，后經(jīng)歷數(shù)次重大修訂。根據(jù)該條款，美國(guó)國(guó)際貿(mào)易委員會(huì)有權(quán)調(diào)查有關(guān)專利和注冊(cè)商標(biāo)侵權(quán)的申訴，此外也開展涉及盜用商業(yè)機(jī)密、商品包裝侵權(quán)、仿制和虛假?gòu)V告等內(nèi)容的調(diào)查。
根據(jù)有關(guān)程序，美國(guó)國(guó)際貿(mào)易委員會(huì)在啟動(dòng)“37調(diào)查”后，該機(jī)構(gòu)必須在４５日內(nèi)確定終裁的目標(biāo)時(shí)間，并盡快完成調(diào)查，通常案件需要在一年內(nèi)作出裁決。如果涉案企業(yè)被裁定違反了第37條款，美國(guó)國(guó)際貿(mào)易委員會(huì)將發(fā)布相關(guān)產(chǎn)品的排除令和禁止進(jìn)口令，這意味著涉案產(chǎn)品將徹底喪失進(jìn)入美國(guó)市場(chǎng)的資格。
今年以來，美國(guó)對(duì)中國(guó)產(chǎn)品多次發(fā)起“雙反”調(diào)查和“37調(diào)查”，貿(mào)易保護(hù)主義明顯升溫。除個(gè)別產(chǎn)業(yè)免遭制裁之外，幾乎所有受調(diào)查的產(chǎn)品都被施以貿(mào)易制裁。（環(huán)球電子導(dǎo)報(bào)）

USITC INSTITUTES SECTION 337 INVESTIGATION ON CERTAIN ELECTRONIC IMAGING DEVICES
The U.S. International Trade Commission (USITC) has voted to institute an investigation of certain electronic imaging devices. The products at issue in this investigation are mobile phones, tablet computers, and other devices having imaging capabilities.
The investigation is based on a complaint filed by FlashPoint Technology, Inc. of Peterborough, NH, on May 23, 2012. The complaint alleges violations of section 337 of the Tariff Act of 1930 in the importation into the United States and sale of certain electronic imaging devices that infringe patents asserted by complainant. The complainant requests that the USITC issue an exclusion order and cease and desist orders.
The USITC has identified the following as respondents in this investigation:
HTC Corporation of Taiwan;
HTC America, Inc., of Bellevue, WA;
Pantech Co., Ltd., of Republic of Korea;
Pantech Wireless Inc. of Atlanta, GA;
Huawei Technologies Co., Ltd., of China;
FutureWei Technologies, Inc., d/b/a Huawei Technologies (USA), of Plano, TX;
ZTE Corporation of China;
ZTE (USA) Inc. of Richardson, TX.
By instituting this investigation (337-TA-850), the USITC has not yet made any decision on the merits of the case. The USITC's Chief Administrative Law Judge will assign the case to one of the USITC's six administrative law judges (ALJ), who will schedule and hold an evidentiary hearing. The ALJ will make an initial determination as to whether there is a violation of section 337; that initial determination is subject to review by the Commission.
The USITC will make a final determination in the investigation at the earliest practicable time. Within 45 days after institution of the investigation, the USITC will set a target date for completing the investigation. USITC remedial orders in section 337 cases are effective when issued and become final 60 days after issuance unless disapproved for policy reasons by the U.S. Trade Representative within that 60-day period.

The investigation is based on a complaint filed by SI Group, Inc., of Schenectady, NY, on May 21, 2012. The complaint alleges violations of section 337 of the Tariff Act of 1930 in the misappropriation of trade secrets asserted by SI Group, Inc., and the importation into the United States and sale of certain rubber resins, including "tackifier" ("tackifiers") made using trade secrets asserted by SI Group, Inc. The complainants request that the USITC issue an exclusion order and a cease and desist order.
The USITC has identified the following as respondents in this investigation:
